1. GENERAL INFORMATION & SCOPE
These Terms and Conditions (“Terms”) apply to the Ko Kitchen Membership Card Program (“Program”) and are binding for all users (“Members”) who register and activate a membership card through Ko Kitchen’s platform.
Ko Kitchen is operated by Nico Borchert, Harzer Street 39, 12059 Berlin, Germany (referred to as “Company,” “we,” “us,” or “our”). All memberships are personal agreements between the Member and Ko Kitchen and are subject to these Terms.
These Terms constitute the entire agreement between the Member and Ko Kitchen regarding the Program. The Terms supersede any prior agreements, understandings, or communications. By activating a membership card, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. MEMBERSHIP CARD ACTIVATION & ACCOUNT CREATION
2.1 Registration Requirements
To create a Ko Kitchen membership account, you must:
- Be at least 18 years of age
- Provide accurate, complete, and current personal information
- Accept these Terms and Conditions
- Accept our Privacy Policy
- Maintain accurate contact details (email and phone number)
2.2 Account Responsibility
You are solely responsible for maintaining the confidentiality of your login credentials, password, and digital wallet information. You must immediately notify Ko Kitchen at info@kokitchen.berlin if you suspect unauthorized access to your account or card.
Ko Kitchen is not responsible for any losses, damages, or unauthorized transactions that occur due to your failure to maintain confidentiality or your negligence in protecting your account information.
2.3 One Account Per Person
Members may only maintain a single active membership account. Creating multiple accounts is prohibited. Ko Kitchen reserves the right to deactivate duplicate accounts without refund.
2.4 Card Installation
Upon successful payment, your digital membership card will be issued and available for installation in your device’s mobile wallet (Apple Wallet, Google Pay, or equivalent). Ko Kitchen provides installation links via confirmation email. If you need to reinstall your card, the installation link will be provided upon request.
3. MEAL ALLOWANCES & VALIDITY PERIOD
3.1 Meal Inclusions
Your Ko Kitchen membership card includes a specific number of meals as outlined in your selected plan (e.g., 10 meals monthly, 20 meals monthly, etc.). Each meal may include:
- Any main dish on our menu priced up to the designated amount specified for your plan
- If you select a dish exceeding the designated price limit, a flat supplement applies as clearly displayed at purchase
3.2 Monthly Validity Period
All meals included in your membership are valid for one calendar month from the date of card activation or renewal. The validity period is non-extendable.
3.3 Expiration of Unused Meals
Any meals not consumed within the one-month validity period will automatically expire and cannot be claimed, transferred, refunded, or carried over to the next billing period. You are solely responsible for tracking and consuming your allocated meals within the validity window.
3.4 Redemption Window
Meals may be claimed only during the following times on days Ko Kitchen is open:
- 13:30 to 15:00 (1:30 PM to 3:00 PM)
Meals claimed outside this window may be subject to additional fees or may be denied.
3.5 Meal Selection & Usage
- Each meal claim deducts one meal from your remaining balance
- You may use your meals for any eligible menu item within the price limit specified for your plan
- Usage is tracked automatically upon presentation of your digital card at redemption
- Screenshots or screen captures of your card are NOT valid for redemption
4. BILLING & PAYMENT TERMS
4.1 Membership Fee
You agree to pay the Membership Fee as specified in your selected plan. Fees are billed at regular intervals as specified in your plan (monthly, quarterly, etc.).
4.2 Payment Method
Payment must be made using one of the payment methods offered through Ko Kitchen’s platform (credit card, debit card, or other digital payment methods). You authorize Ko Kitchen to charge your payment method on the billing date specified in your confirmation email.
4.3 Billing Frequency & Next Billing Date
Your membership will be renewed and charged automatically on the next billing date specified in your confirmation email. You will receive a confirmation email prior to each billing cycle detailing:
- Card name
- Price
- Meals included
- Billing frequency
- Next billing date
4.4 Payment Failures
If a payment attempt fails:
- Ko Kitchen will notify you immediately
- You must provide valid payment information within 5 business days
- If payment is not received, Ko Kitchen reserves the right to suspend or deactivate your membership card
- Any processing fees or chargeback fees resulting from failed payments are the Member’s responsibility
4.5 Automatic Renewal & Meal Reset
Upon successful renewal payment, your card is automatically updated and reset with the full meal allowance specified in your plan. All unused meals from the previous billing period are forfeited. The new meal validity period begins immediately upon renewal.
5. PLAN CHANGES & UPGRADES
5.1 Plan Modifications by Ko Kitchen
Ko Kitchen reserves the right to modify, add, remove, or discontinue plans at any time. Members will be notified of significant changes via email at least 7 days in advance.
6. CANCELLATION & TERMINATION
6.1 Cancellation Procedure
To cancel your membership, you must send a written email to info@kokitchen.berlin with the subject line “Membership Cancellation” and include your full name and membership account details.
6.2 Notice Period
Cancellation must be submitted at least 7 days before your next renewal/billing date for the cancellation to take effect before the next charge.
For example: If your renewal date is February 9, 2026, cancellation must be requested no later than February 2, 2026.
6.3 Timing of Cancellation
- Cancellations submitted after the notice period expires will take effect for the next billing cycle
- You remain responsible for all charges incurred during the current membership period
- Your access to remaining meals ceases upon cancellation, but you may use any remaining meals until the current validity period expires
6.4 No Refunds
Membership fees are non-refundable under all circumstances, including:
- Unused meals
- Early cancellation within the billing period
- Partial months
- Any other reason
7. CARD USE & RESTRICTIONS
7.1 Personal & Non-Transferable
Your membership card is strictly personal and non-transferable. The card may not be:
- Shared with other individuals
- Used by anyone other than the registered Member
- Sold, gifted, or assigned to another person
- Used for commercial purposes
7.2 Verification Requirements
You must present valid identification matching the name on your membership card at redemption if requested by Ko Kitchen staff.
7.3 Card Loss or Damage
If your card is lost or your card is compromised:
- Contact Ko Kitchen immediately at info@kokitchen.berlin
- Request a replacement a new installation link for your digital wallet if needed
- Any unauthorized use prior to notification is not Ko Kitchen’s responsibility
8. RESTRICTIONS & PROHIBITED USES
8.1 Prohibited Conduct
Members must not:
- Use the membership card for any illegal, fraudulent, or deceptive purpose
- Allow unauthorized third parties access to the card or account
- Attempt to resell, redistribute, or commercialize the membership card or meals
- Screenshot, photograph, or otherwise reproduce the card without authorization
- Attempt to gain unauthorized access to Ko Kitchen’s systems
- Engage in any activity that interferes with Ko Kitchen’s operations
8.2 Suspension & Deactivation
Ko Kitchen reserves the right to suspend or permanently deactivate your membership without refund if you:
- Violate any provision of these Terms
- Engage in fraudulent or deceptive conduct
- Provide false or misleading information
- Default on payment obligations
- Attempt unauthorized access or misuse of the card
- Violate Ko Kitchen’s community standards or conduct policies
9. LIMITATION OF LIABILITY
9.1 Service Provision “As-Is”
Ko Kitchen provides the Program and digital membership card on an “as-is” basis. Ko Kitchen makes no warranties regarding:
- Uninterrupted service availability
- The technical compatibility of the membership card with all devices
- Specific meal selections or menu offerings
- Third-party payment processor functionality
9.2 Limited Liability
Ko Kitchen’s total liability for any claims arising from the Program is limited to the amount of the Membership Fee paid in the current billing period. This includes liability for:
- Technical failures or service interruptions
- Lost or corrupted account information
- Third-party payment processor issues
- Device compatibility problems
9.3 Exclusions
Ko Kitchen is not liable for:
- Losses resulting from your failure to comply with these Terms
- Damages caused by third-party providers (payment processors, wallet providers, etc.)
- Losses due to your negligence or misuse of the card
- Indirect, incidental, or consequential damages
- Any other losses not expressly covered herein
10. DATA PROTECTION & PRIVACY
10.1 Privacy Policy
Ko Kitchen processes personal data in accordance with the Ko Kitchen Privacy Policy, which is incorporated by reference into these Terms. By accepting these Terms, you also consent to data processing as described in the Privacy Policy.
10.2 Data Sharing
Ko Kitchen will only use your personal information to:
- Administer the membership program
- Process payments
- Communicate with you regarding your membership
- Comply with legal obligations
- Prevent fraud and abuse
- Marketing and promotional communications
Your personal data will not be sold or transferred to third parties outside of necessary service providers without your explicit consent.
11. TERMINATION OF THE PROGRAM
11.1 Ko Kitchen’s Right to Terminate
Ko Kitchen may terminate or discontinue the membership program at any time with 7 days’ written notice to all Members. In the event of program termination:
- Ko Kitchen will provide a pro-rata refund of unused Membership Fees based on the remaining validity period
- Unused meals will be forfeited and replaced with a partial refund of the Membership Fee
- All outstanding charges must be settled
12. AMENDMENTS TO THESE TERMS
12.1 Right to Modify
Ko Kitchen reserves the right to modify these Terms at any time. Changes will be effective:
- Immediately for technical or legal changes
- 30 days after written notice for material changes that affect your rights or obligations
12.2 Notice & Acceptance
Ko Kitchen will notify Members of significant amendments via email. Continued use of the membership card after the effective date constitutes your acceptance of the modified Terms. If you do not accept the modifications, you may cancel your membership without penalty.
13. INTELLECTUAL PROPERTY
All content, designs, logos, and intellectual property related to Ko Kitchen and the membership program are the exclusive property of Ko Kitchen. Unauthorized use, reproduction, or distribution is strictly prohibited.
14. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if not possible, will be severed. The remaining Terms will continue in full force and effect.
15. GOVERNING LAW & DISPUTE RESOLUTION
15.1 Applicable Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.
15.2 Dispute Resolution
Any disputes arising from these Terms or the membership program will be resolved in the courts of Berlin, Germany. Both parties agree to submit to the exclusive jurisdiction of the Berlin courts.
15.3 Consumer Rights
For consumers (natural persons not acting in a commercial capacity), additional consumer protection rights may apply under German law (BGB – Bürgerliches Gesetzbuch) and EU regulations, which take precedence over these Terms to the extent required by law.
16. ENTIRE AGREEMENT
These Terms, along with the Ko Kitchen Privacy Policy and the confirmation emails sent to you, constitute the entire agreement between you and Ko Kitchen regarding the membership program. These Terms supersede all prior agreements, understandings, and communications.

By clicking “Accept” or “I Agree” during registration, you acknowledge that you:
- Have read and understood these Terms and Conditions
- Agree to be bound by these Terms
- Are at least 18 years of age
- Agree to the automatic renewal and billing terms
- Consent to data processing as outlined in the Privacy Policy
